California Privacy Statement

1. About This Statement

This California Privacy Statement supplements the LUXGAS Privacy Policy and applies to personal information relating to California residents.

The LUXGAS Privacy Policy explains our broader practices concerning the collection, use, disclosure, retention and protection of personal information. This Statement provides additional information and privacy choices relevant under applicable California privacy law.

LUXGAS is headquartered in Estonia and supplies registered business customers in the United States, Europe and other markets. Our customer-facing activities are conducted online. We also use a third-party logistics provider with warehouse operations in California to support fulfilment and delivery.

The availability of a particular privacy right depends on the California law applicable to LUXGAS and the circumstances of the request.

2. Notice at Collection

During the preceding 12 months, LUXGAS collected the following categories of personal information, depending on how a person interacted with us.

LUXGAS does not intentionally request Social Security numbers, precise GPS location, biometric identifiers, medical information, account passwords or similar sensitive information through its distributor enquiry form.

We do not use or disclose sensitive personal information to infer characteristics about California residents.

3. CRM Lead Scoring

Information submitted through the distributor form and related attribution information may be processed through our internally managed customer-relationship management system.

The CRM may generate a lead-quality score using information such as:

  • Business type

  • Country and location

  • Requested pallet quantity

  • Contact information

  • Message content

  • Business qualification information

  • Traffic source and attribution information

This score helps the LUXGAS sales team prioritise follow-up. It does not independently accept or reject an enquiry, determine prices or make another legally significant decision.

Members of the LUXGAS team review and handle business enquiries.

4. Sources of Personal Information

We collect personal information from:

  • You when you submit an enquiry or communicate with us

  • Your interactions with the LUXGAS website

  • Cookies and similar technologies

  • Referral, analytics, advertising and campaign sources

  • Your business or its authorised representatives

  • Banks and transaction providers

  • Logistics, warehouse, fulfilment and delivery providers

  • Providers supporting our website, communications, CRM, security and business operations

  • Publicly available business sources where legally permitted

5. Disclosures During the Preceding 12 Months

During the preceding 12 months, LUXGAS disclosed personal information for business purposes to service providers, contractors and other recipients supporting our operations.

These disclosures may have included:

  • Identifiers and business contact information disclosed to email, communication, CRM, hosting and customer-support providers

  • Commercial and transaction information disclosed to banks, accountants, fulfilment providers and professional advisers

  • Internet activity, online identifiers, approximate geolocation and website-derived inferences disclosed to hosting, security, analytics, attribution and advertising providers

  • Professional or business-related information disclosed to authorised service providers supporting business enquiries and transactions

  • Payment and bank-transfer information disclosed to banks, accounting providers and professional advisers where necessary

  • Delivery and fulfilment information disclosed to logistics, warehouse and delivery providers

We may also disclose relevant information to regulators, courts, law-enforcement bodies or other authorities where required by law.

LUXGAS does not routinely disclose distributor enquiries to unrelated third parties. If an enquiry needs to be referred to a distributor, agent or business partner, the disclosure will be limited to an appropriate business purpose and supported by a lawful basis.

6. Sale and Sharing of Personal Information

LUXGAS has not sold personal information, as “sale” is defined under the California Consumer Privacy Act, during the preceding 12 months.

During the preceding 12 months, where analytics, attribution, conversion-measurement or advertising technologies were enabled, LUXGAS shared the following categories of personal information:

  • Identifiers and online identifiers

  • Internet or other electronic-network activity

  • Approximate geolocation information

  • Website-derived inferences

These categories were shared with analytics, attribution and advertising providers for purposes including campaign measurement, conversion attribution, website analytics and cross-context behavioural advertising where applicable.

LUXGAS does not knowingly sell or share the personal information of anyone under 16 years of age.

7. Opting Out of Sale or Sharing

California residents may request to opt out of the sale or sharing of personal information by:

  • Enabling a recognised Global Privacy Control signal in their browser

  • Using the privacy or cookie controls available on the LUXGAS website

  • Emailing privacy@lux-gas.com

LUXGAS honours a recognised Global Privacy Control signal as an opt-out request for the browser or device sending the signal where applicable.

An opt-out request does not require the creation of an account. Information submitted for an opt-out request will be used only to process and maintain a record of that request.

LUXGAS does not sell personal information. An opt-out request therefore primarily applies to website disclosures that California law may classify as sharing for cross-context behavioural advertising.

8. California Privacy Rights

Where applicable California law grants these rights, a California resident may request:

  • Access to the categories of personal information collected about them

  • Access to specific pieces of personal information collected about them

  • Information about the sources from which personal information was collected

  • Information about the purposes for collecting, using, selling or sharing personal information

  • Information about the categories of recipients to whom personal information was disclosed, sold or shared

  • Correction of inaccurate personal information

  • Deletion of personal information, subject to applicable exceptions

  • Opt-out from the sale or sharing of personal information

  • Limitation of certain uses or disclosures of sensitive personal information where applicable

  • Non-discriminatory treatment for exercising an applicable privacy right

LUXGAS may retain information where necessary to:

  • Complete or administer a transaction

  • Maintain accounting, tax or legally required records

  • Detect or prevent fraud and security incidents

  • Protect legal rights

  • Resolve disputes

  • Comply with contractual or legal obligations

  • Exercise another exception permitted by applicable law

9. Submitting a Privacy Request

LUXGAS conducts its customer-facing operations online. California privacy requests may be submitted to:

Please include:

  • Your name

  • Your business email address

  • Your business name, where applicable

  • The privacy right you wish to exercise

  • Information reasonably necessary to locate the relevant records

  • The period covered by your request, where relevant

Please do not send identity documents, bank information, passwords or other sensitive information unless LUXGAS specifically requests the information through an appropriate secure method.

10. Verification and Response Process

Before completing certain requests, we may verify that the requester is the person to whom the personal information relates.

Verification may involve matching the information provided in the request with information already maintained by LUXGAS, including:

  • Name

  • Business email address

  • Business name

  • Contact information

  • Information concerning a recent enquiry or communication

Information collected for verification will be used only to verify the request, protect security, prevent fraud and comply with applicable law.

If we cannot reasonably verify a request, we may be unable to disclose specific information or complete the request. We will explain the decision where required.

Where applicable law requires a response, we will normally respond within 45 calendar days of receiving the request. If reasonably necessary and legally permitted, we may extend the response period by an additional 45 calendar days. We will provide notice and explain the reason for the extension.

We generally do not charge a fee. Where permitted by law, we may refuse or charge a reasonable fee for requests that are manifestly unfounded, excessive or repetitive.

11. Authorised Agents

A California resident may appoint an authorised agent to submit a privacy request on their behalf.

We may require:

  • Evidence that the resident authorised the agent

  • Verification of the resident’s identity

  • Direct confirmation from the resident that the agent has permission to submit the request

Different requirements may apply where the authorised agent holds a legally valid power of attorney.

12. No Financial Incentive and Non-Discrimination

LUXGAS does not offer financial incentives, different prices or different service levels in exchange for collecting, retaining, selling or sharing personal information.

We will not unlawfully discriminate against a California resident for exercising an applicable privacy right.

LUXGAS may be unable to provide a requested service where information the resident asks us to delete or stop processing is reasonably necessary to provide that service, complete a business transaction or comply with the law.

13. Privacy-Request Records

Where the California Consumer Privacy Act applies, LUXGAS will retain records of California privacy requests and our responses for at least 24 months.

These records will be used only for compliance, security, internal process review and other legally permitted purposes.

14. Changes to This Statement

We may update this California Privacy Statement when our processing practices, technologies, services or legal obligations change.

The updated Statement will be published on the LUXGAS website with a revised “Last updated” date.
